1. Introductory provisions

1.1. These General Terms and Conditions govern the contractual relations between Empiria Towel Massage Therapy Centre, hereinafter referred to as “the Operator”, and the person booking a massage appointment and purchasing massage services, gift vouchers or other products, hereinafter referred to as “the Customer”, when ordering services offered by the Operator on the dev.empiriatowel.cz website.

1.2. The contractual relationship between the operator and the customer, hereinafter referred to as the “contracting parties”, is governed by the currently valid price list and the General Terms and Conditions published on the website dev.empiriatowel.cz.

1.3. These Terms and Conditions become an integral part of any contractual relationship concluded between the Operator and the Customer.

1.4. The Operator may change or supplement the wording of the Terms and Conditions.

2. Governing law and legal regime

The contractual relations between the Parties shall be governed by the law of the Czech Republic.

3. Process of ordering and payment for services

3.1. Ordering – by ordering through the booking system or by purchasing a gift voucher, the customer expresses his/her interest in the service and his/her acceptance of these terms and conditions. Acceptance of the customer’s completed order by the operator is required for the conclusion of the contract.

3.2. The customer’s order must contain sufficient information to identify the customer (name and surname, telephone number and e-mail address), identify the product or service ordered.

3.3. The services are paid by the customer in cash, cashless transfer/QR code, gift voucher or through Benefit Plus, Benefity, Sodexo, Edenred, Unišek/Galerie Beta benefit programs.

3.4. The customer is obliged to inform the operator if he/she does not receive an email confirmation of the massage booking.

4. Terms and conditions for using gift vouchers

4.1. The gift voucher entitles the customer to use the services listed on dev.empiriatowel.cz.

4.2. The gift voucher can only be redeemed and the services used within 1 year from the date of purchase, unless otherwise agreed by the parties. The expiry date is indicated on the gift voucher.

4.3. The customer is obliged to book the selected services via the booking form at www.empiriatowl.cz. The operator can forward the information to the customer by email or telephone.

4.4. The gift voucher is not redeemable for cash and cannot be returned, no copying or other modification of the gift voucher is allowed. It is valid for one time.

4.5. In the event that a customer is booked on a gift voucher and fails to turn up without cancelling the binding reservation, the gift voucher will be forfeited by the customer.

4.6. By purchasing a gift voucher, the customer confirms that he/she has read these terms and conditions and agrees to them.

4.7. The customer is obliged to make the gift recipient aware of the terms and conditions set out herein.

4.8. By accepting the gift voucher, the recipient agrees to the terms and conditions set out herein.

5. Date of visit

5.1. The date of the visit must be booked in advance at dev.empiriatowel.cz.

5.2. Information regarding the appropriate type of massage or the selection of a suitable masseuse/masseur will be provided by the operator to the customer by email or telephone.

5.3. The booked appointment becomes a binding order.

5.4. The operator reserves the appropriate time and studio space for the customer’s booked appointment.

5.5. The studio space is not accessible at any time. The customer must arrive at the exact time reserved.

6. Rebooking and cancellation conditions

If the customer is unable to attend the massage on the date of the booking, the customer shall inform us in advance by phone or email, but no later than 24 hours before the date of the massage booking. Late re-booking is considered as an absence of the customer.

7. Absence of the customer

In the event of absence, the customer will be required to pay 100% of the value of the booked massage time, or it will be deducted from the value of the gift voucher.

8. Refusal and early termination of the massage

8.1. The massage may be refused without refund in the following cases:

a. the customer presents for the massage with obvious symptoms of infectious diseases,

b. the customer arrives for the massage in a drunken state or under the influence of addictive substances,

c. the customer presents for a massage with medical problems of a medical nature,

d. the customer presents for massage in an unsanitary condition.

8.2. Massage may be terminated early without refund if during the massage:

a. the client develops obvious symptoms of infectious diseases; or

b. the client shows obvious signs of intoxication or substance abuse; or

c. the customer shows obvious signs of health problems; or

d. the customer behaves in a disorderly manner.

 

9. Escort and accessibility

9.1. The customer cannot be accompanied by another adult to the massage – the only exception is children and minors.

9.2. The studio is not set up for children to be present with an adult who has a massage appointment booked.

9.3. The studio is not set up for the presence of pets.

9.4. The studio does not have a reception desk – for this reason, the operator cannot allow the customer to enter the studio premises earlier than the booked massage time.

 

10. Personal belongings and valuables

The operator is not liable for any possible loss of the customer’s belongings before, during or after the massage.

 

11. Informed consent of the customer

11.1. Before the first massage, the customer is instructed about the health risks, indications and contraindications. If he/she decides to have a massage, he/she gives his/her clear and free informed consent.

11.2. Occupational safety and risk prevention in the workplace

By entering the studio premises, the customer gives his/her consent:

a. his/her obligation to comply with the rules of occupational safety and risk prevention in the workplace on the studio premises; and

b. the obligation to comply with the safety instructions of the masseuse/masseur.

 

12. Price list

The price list of massage services and products is available on the operator’s website dev.empiriatowel.cz.

 

13. Service Complaints

13.1. In the event of a complaint about the services provided, the customer must immediately on the spot after the massage and in a credible manner prove that the subject of the complaint is related to a specific fault of the operator.

13.2. Complaints shall be submitted in writing to the address of the operator.

13.3. Subsequent complaints will not be taken into account due to lack of evidence.

13.4. In the event of an unfounded complaint, the costs of the complaint will be recovered from the customer.

13.5. After the massage, the customer is informed about possible reactions to the massage.

 

14. Personal data protection

Processing of personal data: the customer expressly agrees that the operator is entitled, in accordance with the relevant generally applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data, to process and store all information and data provided by the customer for the purpose of processing the order (name, email, telephone number). By providing his/her email address, the Customer agrees to the sending of Business Communications to his/her email address, this consent can be revoked at any time.

 

15. Final Arrangements

15.1. The contractual relations between the Parties shall be governed by the law of the Czech Republic.

15.2. The Parties expressly declare that they have entered into these Terms and Conditions after thoroughly familiarizing themselves with their contents, freely and seriously, accept them and undertake to observe the rights and obligations set out therein.
